At our winter Local Government Forum, we will provide a detailed summary of the significant changes to the laws impacting on leasing and licencing in the last decade.
From 22 April 2021 the Retail Commercial Leases (Prescribed Lessee) Variation Regulations 2021 came into operation. These regulations have resulted in the most significant change to the compliance obligations of Councils when leasing and licensing premises to clubs, community groups, charities and other not for profit organisations since the Retail and Commercial Leases Act (Act) commenced in 1995.
Other significant changes to the Act and other legislation will be covered, including the Local Government Act 1999, Crown Land Management Act 2009 and the common law.
We will provide a practical guide for dealing with occupancy arrangements in relation to sporting and community facilities, commercial properties, caravan parks, Crown land, community land, telecommunications towers, roads and anything else attendees wish to discuss. We will cover ground leases, short term and long term arrangements, commercial and community leases and licences, hire agreements, management agreements and everything in between.
Attendees will also be provided with an updated 2021 Leasing and Licencing checklist that can be used as a guide when granting leases or licences.
